Greater Noida : The National Commission has ordered the leading developer of housing projects in Greater Noida, Unitech Limited to pay for over Rs 48 lakh to a Delhi resident for neglecting to deliver the possession of flat booked in its Greater Noida housing society about ten years back.
National Consumer Disputes Redressal Commission (NCDRC) also directed the company to pay an interest on amount received @ 18% p.a. from the year 2008 A bench of Justice J M Malik instructed the builder to refund the money received from a Delhi-based home buyer named Bhupinder Singh, observing that “almost ten years will elapse. No headway has been created according to the condition of the tower under consideration
Commission noted that the opposite party has already received the lion’s share from the cost of the apartment in Greater Noida until December 5, 2008. And still did not give them the possession of flat booked by them. Its Almost ten years now and developer company has never given a satisfactory answer to Mr. Singh . When home buyer had enough of running to the developers office but got no resolution of his problem then finally in the year 2015, he went to the National Commission for justice.
Commission observed that the Unitech took the most of the money and utilized it in its other projects instead of building the apartment for the complainant. A fabian policy seems to have adopted by the builder to create profit at the expense of others. The bench directed the firm to “return the whole amount received i.e., Rs 48,03,982 together with the interest at the rate of 18% simple interest from the time of money received & till its realization.”The commission also granted a compensation of Rs 50,000 towards the complainant.
Based on the complaint, Singh had booked a flat in firm’s Unitech Horizon in Greater Noida, Uttar Pradesh in May 2006. Total price consideration was Rs 49,85,380 by December 2008, while he has already compensated Rs 48,03,982 to the builder.
Though the builder had assured him at the time of booking of flat that he will receive the possession of flat by November 2008 but remain unsuccessful in doing this, it stated, adding that the complainant kept running from pillar to post from 2009 till 2015 but was always given false promises which brought him to file a complaint in the National commission.
